General Terms and Conditions
Hotel ABC Chur | Hidden Paradise Resorts AG

1. Scope

These general terms and conditions for room bookings (‘GTC’) apply to all hotels belonging to Hidden Paradise Resorts AG, based in Bonaduz, for the provision of hotel rooms for the accommodation of customers, as well as all other services and deliveries provided by the hotel in this context.

The customer's general terms and conditions do not apply.

The GTC are also available in German. In the event of discrepancies, the German version shall prevail.

2. Conclusion of contract

An individual reservation requires a guarantee. With the room guarantee, the reservation remains valid for the entire night.

The following are accepted as guarantees for a room reservation:

• Credit card (Visa, American Express, Diners Card, Mastercard, JCB, etc.)
• Advance payment for one night, e.g. by bank or postal transfer
• Written guarantee from a company listed in the commercial register with its registered office in Switzerland

An offer for group reservations is explicitly designated as such and must be confirmed in writing by the customer to the hotel. Offers are subject to change until confirmed by the hotel. This means in particular that offers, price lists and similar documents issued by a hotel do not constitute a binding offer. In the event of a new enquiry, the new offer may differ from the first offer.

3. Services and prices

The customer does not acquire any right to the provision of specific rooms. However, the hotel undertakes to keep rooms of the reserved category available. If, upon arrival, no room equivalent to the one reserved is available for unforeseen reasons, accommodation will be provided in a room of the next higher category. If no room is available at the hotel, the hotel will arrange for accommodation of at least equivalent standard at another hotel.

The customer is obliged to pay the hotel's applicable or agreed prices for the provision of the room and any other services used by them. This also applies to services and expenses incurred by Hidden Paradise Resorts AG to third parties at the customer's request.

Prices are quoted in CHF. The composition of the price, the services included in the price and any surcharges will be stated in the confirmation.

4. Room handover and return

Booked rooms are available to the customer from 3 p.m. on the agreed day of arrival. The customer is not entitled to check in earlier.

On the agreed departure day, the rooms must be vacated and made available to the hotel by 12 noon at the latest. After this time, the hotel may charge 50% of the full accommodation price (list price) for use of the room beyond the contractual period until 5 p.m. and 100% after 5 p.m. due to the delayed vacating of the room.

5. Payment

The costs incurred are usually paid upon departure. If payment by invoice is agreed, these are payable without deduction within 30 days of receipt of the invoice. The hotel is entitled to demand payment of accrued claims at any time and to demand immediate payment.

The hotel is entitled to demand a reasonable advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment and the payment dates will be announced with the offer.

If the customer is resident abroad, the hotel reserves the right to debit the entire invoice amount from the guarantee credit card. Any exchange rate differences or bank charges shall be borne by the customer.

The customer may only offset a claim against a claim by the hotel if the claim is undisputed or legally binding.

6. Cancellation policy

6.1 Cancellation policy for individual reservations

Individual reservations are normally considered final once the offer from Hidden Paradise Resorts has been confirmed. In the event of a last-minute cancellation after the cancellation deadline, 100% of the cost of one night's accommodation may be charged.

Cancellation policies may vary depending on the hotel and offer. However, certain rates are subject to special conditions that do not allow cancellation. Unless otherwise stated, the following conditions apply to individual reservations:

• Cancellation by 6 p.m. on the day before arrival: no charge
• Cancellation after 6 p.m. on the day before arrival: charge for one night's accommodation
• Cancellation during your stay (multiple nights): charge for one additional night

6.2 Cancellation policy for groups

The cancellation policy for group reservations is regulated separately. If no separate cancellation policy exists, the following applies:

• Cancellation up to 28 days prior to arrival free of charge
• Cancellation 27 to 21 days prior to arrival: 30% of the expected total turnover
• Cancellation 20 to 7 days prior to arrival: 50% of the expected total turnover
• Cancellation 6 to 0 days prior to arrival: 100% of the expected total turnover
  

7. Withdrawal by Hidden Paradise Resorts AG hotels

If the customer is entitled to cancel free of charge in accordance with clause 6 above or a separate agreement, the hotel is entitled to withdraw from the contract during this period if other customers enquire about the contractually booked rooms and the customer does not waive their right to cancel free of charge upon enquiry by the hotel.

If an agreed advance payment is not made even after a reasonable grace period set by the hotel has expired, the hotel is also entitled to withdraw from the contract.

Furthermore, the hotel is entitled to withdraw from the contract for objectively justified reasons, for example if:

• force majeure or other circumstances beyond the hotel's control make it impossible to fulfil the contract
• rooms are booked under misleading or false statements of material facts, e.g. regarding the identity of the customer or the purpose of the booking
• the hotel has reasonable grounds to believe that the use of the hotel's services may jeopardise the smooth running of the business, the safety or the public image of the hotel, without this being attributable to the sphere of control or organisation of Hidden Paradise Resorts AG
• there is a breach of the above clause 5.

In the event of justified withdrawal by the hotel, the customer shall not be entitled to claim damages.

8. Bookings through tour operators

For bookings made through a tour operator, the tour operator's general terms and conditions apply.

9. Children's prices

Surcharges for children vary depending on age and are indicated in the hotel's offer.
